By downloading, installing, or using TomYaYa software ("Software") or accessing our website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software or Service.

License Grant

Free Version

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

  • Download and install the Software on your personal devices
  • Use the Software for personal, non-commercial purposes

Pro and Business Versions

Upon purchase of a valid license, we grant you a limited, non-exclusive, non-transferable license to:

  • Use the Software according to your license tier (personal or commercial)
  • Install the Software on the number of devices specified by your license
  • Receive free updates for the major version purchased

Restrictions

You may NOT:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Remove or alter any proprietary notices or labels
  • Use the Software for illegal purposes
  • Sublicense, rent, or lease the Software
  • Use the Software to develop competing products
  • Circumvent any copy protection or licensing mechanisms

Intellectual Property

The Software and all related content, features, and functionality are owned by TomYaYa and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content

The Software processes files on your local device. You retain all rights to your files. We do not claim any ownership or rights over your content.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS

We do not warrant that the Software will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TOMYAYA BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Any damages exceeding the amount you paid for the Software

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

Data Loss Warning

Important: While TomYaYa includes safeguards against accidental data loss, you are responsible for maintaining backups of your files. We recommend:

  • Always keeping backups before using deduplication features
  • Reviewing files before permanent deletion
  • Using the preview feature before batch operations

Refund Policy

We offer a 30-day money-back guarantee for all paid licenses. To request a refund:

  • Contact us within 30 days of purchase
  • Provide your order number and email
  • Refunds are processed within 5-10 business days

Updates and Changes

We may update the Software and these Terms from time to time. Continued use of the Software after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your license immediately, without prior notice, for any breach of these Terms. Upon termination, you must cease all use of the Software and destroy all copies.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TomYaYa operates, without regard to conflict of law principles.

Severability
